Need to update contract terms? Here's how to make changes using amendments, based on your contract type.
What Is an Amendment?
An amendment is a formal update to a contract that both you and the worker agree on. In Ontop, that usually means changes like:
Compensation updates - This can include fix payments or pay per task contracts.
Tweaks to the scope of work
Adjusting the contract's valid dates
Amendments keep things accurate and up to date on both sides.
Types of Contracts and How to Amend Them
Amending a Contractor of Record - Ontop agreement
Both sides need to sign for changes to go live
The new start date must be in the future, and can’t be earlier than this month
If the contract hasn’t started yet (Pending to start), the amendment must start on the same date as the contract
The update only kicks in once both parties sign and the start date arrives
Amending a Direct Hiring
Both sides need to sign the updated Independent Contractor Agreement
You can pick any start date within the contract’s original dates
Changes go live after both signatures are in and the start date hits
What Can Be Changed with an Amendment?
1. Compensation
Payment frequency or payment day
Currency
Amount
Commissions
Unit of payment (for Pay per Task/time contracts), for example, here you can change the hourly rates.
2. Scope
Area and title of the role
Role description
Responsibilities
3. Termination
End date of the agreement
How to Create an Amendment
Step 1: Find the contract
Go to My Workforce
Find the contract and click the pencil icon
Heads up: If you don’t see the “Amend contract” button, there might be one already in progress. You can either edit or cancel it to keep going.
Step 2: Add the new details
Give the amendment a title and start date
Select what you want to change
For specific contract types:
Contractor of Record - Ontop agreement and Contractor of Record - Tri-party agreement: Use our built-in amendment template (this is required)
Direct Hiring: You can upload your own signed doc (this one’s optional)
Important: Nothing updates until both parties sign and the start date arrives.
Step 3: Review and confirm
Choose to Sign later or Review and sign now
The worker will get a heads-up to sign on their end
Rules for Amendment Start Dates
Direct Hiring: Start date can be any time during the contract’s original period
Contractor of Record - Ontop agreement and Contractor of Record - Tri-party agreement: Start date must be in the future, not earlier than the current month
Pending Contracts: Start date must match the contract start date
Note: Contract start dates can’t be edited once you’ve created an amendment. Changes only apply from the amendment’s start date forward.
