What is an Amendment?
An amendment is a change to a contract agreed upon by both parties. In the context of payroll, amendments refer to modifications made to a worker’s contract, such as changes in compensation, scope of work, or the validity period of the contract. Amendments ensure that contracts reflect the current terms agreed upon by both parties.
Amending an Ontop Signs Contract
When making amendments to an Ontop Signs contract, both the client and the worker must sign an amendment to their respective agreements. The amendment will only take effect once both parties have signed and the amendment’s start date has passed.
- The start date for the amendment cannot be earlier than the current month.
- You cannot modify the start date of an amendment if the contract status is Pending to start (contract start date not yet reached).
Amending a You Sign Contract
If amending a You Sign contract, you will need to sign an amendment to the Independent Contractor Agreement.
- The amendment’s start date can be any date within the contract's start and end dates.
- Ensure both parties sign the amendment before any changes take effect.
What Can Be Changed with an Amendment?
- Compensation: Periodicity and payment days, currency, amount, commissions, and payment unit (for Pay Per Task contracts).
- Scope: Role area, role title, role description, and responsibilities.
- Termination: Termination date of the agreement.
How to Create an Amendment
- Locate the Contract
Go to the contract list and find the contract you want to amend. Click on the pencil icon next to the contract.
Note: If you don’t see the Amend contract button, it could be because there’s a pending amendment. You can either edit the previous amendment or cancel it to create a new one.
- Enter the Amendment Details
- Enter the amendment title and start date.
- Choose the section(s) you wish to modify.
- You can use Ontop’s amendment template (required for Ontop Signs contracts) or upload your own signed document (for You Sign contracts).
Important: Changes will not be applied until both the client and worker have signed the amendment and the start date has passed.
- Review and Confirm
You can choose to Sign later or Confirm and sign the amendment.
Your worker will receive a notification to sign the amendment. The changes will take effect only after both parties have signed and the start date has arrived.
Proration Removal and Contract Start Date Modification
Currently, proration removal and modifying the contract start date are not possible once an amendment has been created. The amendment start date must adhere to the conditions set by the contract status.
Additionally, any changes to compensation, scope, or termination can only apply from the amendment’s start date forward.
Amendment Start Date Rules
- For You Sign contracts: You can set any date within the contract’s start and end date.
- For Ontop Signs contracts: The amendment start date must be in the future and cannot be earlier than the current month.
- Pending Contracts: If the contract is in Pending to start status, the amendment start date must match the contract’s start date.
